The Spanish labor market has strengthened employment models linked to education and training with the aim of improving youth employability and reducing temporary employment. In this context, the work study training contract has become a regulated mechanism for acquiring professional qualifications while carrying out paid work.

What is a work study training contract?

A work study training contract is a type of employment contract that makes it possible to combine paid work with official education or training, provided that the two are directly related. Its purpose is to enable employees to acquire practical professional skills in a real working environment while completing formal studies.

This type of contract is regulated by the Workers’ Statute, which establishes that the work activity must form part of a structured training process. It is not an academic internship, but rather an employment relationship with full labor rights, including Social Security contributions.

From an employability perspective, work study training helps bridge the gap between the education system and the real needs of companies. This approach is particularly relevant for those seeking to develop their careers in high demand sectors, as is the case with master’s degrees with the best career opportunities, where previous professional experience can provide a significant advantage.

Requirements for a work study training contract

The requirements for a work-study training contract are designed to preserve its educational purpose and prevent inappropriate use of this type of employment arrangement.

For the employee, the main requirement is not to already hold a qualification that would allow them to perform the same role under a professional internship contract. In addition, the education or training program must be directly related to the duties carried out within the company.

In terms of age, the general framework applies to people aged between 16 and 30, although this age limit does not apply in certain cases, such as people with disabilities, groups at risk of social exclusion or contracts linked to university studies or vocational training.

The company must also meet certain conditions. These include being up to date with its obligations to Social Security and the Spanish Tax Agency, having the capacity to provide practical training and appointing a tutor responsible for monitoring the employee’s progress. In larger companies, regulations also require a valid equality plan.

Main characteristics: parts of the contract and key concepts

A work-study training contract is based on a three-party structure involving the company, the employee and the educational institution. This coordination ensures consistency between the academic content and the professional activity.

  • One of the key elements is the distribution of working hours. During the first year, effective working time cannot exceed 65% of the maximum working hours, with the remaining time reserved for training. In the second year, working time can increase to 85%, while a minimum proportion must always remain dedicated to training.
  • The contract can last between three months and two years, depending on the individual training plan. There is no probationary period, and regulations prohibit overtime, night work and shift work except in very specific circumstances.
  • The role of the company tutor is essential to the successful development of the contract. Their responsibility is to supervise the learning process and coordinate with the educational institution. This support is particularly important in technical and advanced management environments, such as those related to the Master in Management STEM, where the practical application of knowledge plays a central role.

Salary and Social Security contributions under a work study training contract

The salary under a work study training contract is determined by the applicable collective bargaining agreement. When the agreement does not specify a particular amount, the minimum remuneration is 60% during the first year and 75% during the second year, always in proportion to the amount of effective working time.

Under no circumstances may the salary be lower than the statutory minimum wage, calculated in proportion to the hours worked. This guarantee protects employees and provides greater legal certainty.

In terms of contributions, the contract provides full Social Security coverage, including unemployment protection and coverage for both common and occupational contingencies. Companies may also benefit from reductions in Social Security contributions, helping to lower employment costs and encourage the recruitment of people who are still in training.

Practical real world examples

A common example is a young person who joins a company in an administrative role while completing an official qualification in business management. During the first year, they combine support tasks with theoretical training, while in the second year they take on greater operational responsibilities.

This type of contract is also common in technical and industrial sectors, where companies train people with no previous experience in areas such as maintenance, data analysis or technology support. The work study model makes it possible to adapt the learning process to the organization’s real working practices.

In small and medium sized companies, this arrangement is often used as a way to bring in young talent, reduce initial employment costs and encourage continued employment once the contract has ended.
